While there has been some scholarship which has explored the procedural aspects of international trials, to date there has been little coordinated analysis of 'evidentiary norms, processes and practices'. This book addresses this neglect by exploring the key evidentiary challenges facing the international tribunals and offers an analysis of how these challenges have been met. In order to do this, the jurisprudence and practice of the various international tribunals is analysed and the evidentiary norms, processes and practices examined with reference to those that have developed in more established common law and civil law jurisdictions. A critical approach is taken towards the treatment of evidentiary issues in the various tribunals and courts with emphasis on how the practices that have been developed measure up against human right norms. After an introductory chapter and a chapter on the relevant international human rights norms, the book is structured around the key topics - the gathering of evidence, disclosure matters, admissibility issues, the presentation of evidence and the evaluation of evidence. Considerable attention is given to the role of victims and victim participation in the international tribunals, as well as to the situation applying in appeal proceedings.
